I agree with Rand Paul on most of his points, but do wonder what specific language can accomplish what he wants. The problem has always been that ObamaCare was designed to fail - and to insinuate itself so deeply into many other laws and regulations that they will continue on if ObamaCare, itself, is repealed. Avik Roy writes at Forbes, it can’t eliminate everything. “The partial repeal bill does not get rid of ObamaCare’s tens of thousands of pages of insurance regulations...” This also defines what would happen for a total repeal.

The stumbling block for bipartisan support, is the necessary cutoff of ObamaCare while the Free Market comes to replace it. The Market will produce the best result, but ObamaCare was crafted to hurt as many people as possible before the Free Market can come into being. The only way to work this is to allow a two tier system. The first would continue existing Medicaid as underwritten by ObamaCare subsidies, while the Free Market is allowed to compete with it. I believe the Free Market result will outperform the ObamaCare leftovers, and the transition then should be painless.

Robert, this is why I just call them two wings of the same party: The Big Government Party.  In DC, all they care about is power, and being part of the DC In-Crowd.  And to achieve both, one must first play by the rules, or be forever a stranger from within.  

I know I keep saying this, but the only 'out' I can see is for a 20-100KT yield mushroom cloud over the Washington Monument.  It gets rid of the power base, all the rich debutantes, who spend the money on making centralized power fun and enjoyable, and a goodly portion of the DC bureaucrats.  And all in one fell swoop.   I know most here think I am nuts, but I can't see any other way to decentralize all this power, as the Founders intended.  

Downsizing requires moral courage, i.e. guts, and that is exclusively lacking in DC.  The downsizing will have to be of the "Instant" variety.  Maybe the Islamists will finally settle down and help us out on this act.

What I see are all the medical filers who have codes written to categorize all medical treatment. You go in for treatment, and after a small time period, current regs disallow the same healthcare provider, if the treatment wasn't 100% successful. There are thousands of bureaucratic landmines in place and ready to destroy any attempt to use common sense. It will take time, but the only way to get rid of Statist control of Health Care is to kill it with the death of a thousand cuts, one step at a time. With a 9th Justice in place, we can stop the inevitable Democrat obstruction using shopped judges and district courts, but the process can not be immediate.

I hope I'm wrong, but I haven't been convinced otherwise, yet.
